1.             Introduction

1.1.        Edulaw (Pty) Ltd is a private company duly incorporated in terms of the Companies Act 71 0f 2008 (“Edulaw”, “we”, “us”, “our”). The Learned Colleagues Club is a trademarked brand of Edulaw (Pty) Ltd T/A The Learned Colleagues Club.

1.2.        Welcome to the Edulaw website (www.edulawsouthafrica.co.za) (“website”) operated by Edulaw. The following Terms and Conditions govern the use of Edulaw’s Website, as well as any subscription to The Learned Colleagues Club WhatsApp Community and Newsletter by Edulaw and/or engaging any of our other services and products including webinars and courses.

1.3.        By using this website or signing up to our newsletter and/or engaging with any of our services, you agree to be bound by these Terms. You must be at least 18 years old (or the age of majority in your jurisdiction) to use Edulaw. By registering, you represent that you have legal capacity to enter into this agreement.

1.4.        These Terms and Conditions are binding and enforceable against all persons (“users”) who access, register, use, and or purchase services on our Website.

1.5.        If you do not agree to these Terms, you may not continue to access this website or utilise our services.

2.             Services

2.1.        Edulaw provides legal education services including self‑paced e‑learning courses, live or recorded examination preparation modules, paid group and/or 1:1 sessions, and access to forums or learning materials. Our services may change from time to time.

3.             Registration and Account Security

3.1.        Registration is required to access certain features such as our courses. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us promptly of any unauthorized use.

4.             Payment and Access

4.1.        Course fees are payable in advance as indicated on the website.

4.2.        Access is granted upon successful payment and continues for the specified duration or until you cancel. Should any payment be declined, we will terminate your access to our website and our services immediately without prior notice.

5.             Refunds, Cancellation & Rescheduling

5.1.        Refunds will only be provided in accordance with applicable South African consumer protection laws.

5.2.        We will not refund you for any sessions missed or partially attended where such event occurs as a result of your own conduct and/or negligence.

5.3.        Edulaw may cancel or reschedule sessions in which case you may request a refund.

6.             Intellectual Property

 

6.1.        Ownership

6.1.1.      All content and materials available on the EduLaw website—including but not limited to text, graphics, logos, icons, images, audio clips, video material, course materials, documents, assessments, learning frameworks, and code (“EduLaw Content”)—are the property of EduLaw (Pty) Ltd, its affiliates, or licensors, and are protected under South African intellectual property laws, including the Copyright Act 98 of 1978, the Trade Marks Act 194 of 1993, the Designs Act 195 of 1993, and relevant common law principles.

6.1.2.      All intellectual property rights, whether registered or unregistered, are reserved.

6.2.        Limited Licence to Users

6.2.1.      Edulaw grants registered users a non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Edulaw Content for personal, private, non-commercial and educational purposes only. This licence does not constitute a transfer of ownership or any intellectual property right.

6.2.2.      You may not:

  • Reproduce, distribute, transmit, republish, display, post, download, store, or otherwise exploit the EduLaw Content in any form or by any means, including photocopying, recording, or other electronic or mechanical methods, without prior written permission;

  • Modify, adapt, or create derivative works from the EduLaw Content;

  • Use any trade mark, logo, or branding owned by EduLaw without our prior written consent.

6.3.        Copyright Infringement and Enforcement

6.3.1.      Unauthorised use, copying, distribution, or reproduction of Edulaw Content is a breach of the Copyright Act and may constitute a criminal offence under section 27 of the Copyright Act. Edulaw reserves the right to pursue all available remedies, including legal action and damages against any person who infringes its intellectual property rights.

6.4.        Trade Marks

6.4.1.      The name Edulaw, Edulaw SA and The Learned Colleagues Club, its logo, slogan(s), and any other branding used on this website are registered and/or common law trademarks of Edulaw (Pty) Ltd. Use of these marks without written permission is strictly prohibited and may result in legal action.

7.             Disclaimers and Limitation of Liability

7.1.        Our services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law.

7.2.        To the extent permitted by applicable law, Edulaw’s liability is limited to the amount you have paid for the services in question.

8.             Indemnity

8.1.        You agree to indemnify and hold harmless Edulaw and its directors, employees, and affiliates from all claims, losses, liabilities, damages, and expenses arising from your breach of these Terms or misuse of the site.

9.             Account Suspension or Termination

9.1.        Edulaw may, at its discretion, suspend or terminate your access if you breach these Terms or for other reasons including non‑payment.

10.         Governing Law and Disputes

10.1.     These Terms are governed by South African law. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

11.         Changes to Terms

11.1.     Edulaw may revise these Terms at any time. Changes are effective immediately upon posting. Your continued use constitutes acceptance of the revised Terms.
